1. Acceptance and definitions

These Terms & Conditions ("Terms") are an agreement between you and Gametarian Interactive Studios Private Limited ("Gametarian", "we", "us"), CIN U74900WB2015PTC206600, registered office in Kolkata, West Bengal, India. They govern your use of gametarian.com and of the digital services, applications, and platforms we operate that reference these Terms (together, the "Services"). By using the Services you accept these Terms; if you do not accept them, do not use the Services.

2. Professional services and engagements

Our software engineering, design, and consulting work is delivered under separate written agreements — proposals, statements of work, or master service agreements — entered into with each client. Where such an agreement exists, its terms prevail over these Terms for that engagement. Descriptions of services, methods, and indicative outcomes on this website are for general information and do not constitute an offer, warranty, or commitment; the scope, deliverables, fees, and warranties for any engagement are exclusively those stated in the applicable written agreement.

3. Use of the Services and accounts

You agree to use the Services only for lawful purposes and in accordance with these Terms. Where a Service supports registration, you are responsible for the accuracy of your registration information, for maintaining the confidentiality of your credentials, and for activity under your account. You must meet any minimum-age requirement stated for a Service; where required by law, users below 18 may use a Service only with verifiable parental consent.

4. Acceptable use

You must not, in connection with any Service:

• Upload, post, share, or transmit content that is unlawful, defamatory, harassing, hateful, or obscene, that infringes another person's rights, or that you do not have the right to share;
• Upload, post, share, or transmit any material that sexualises, exploits, or endangers minors in any form. We operate a zero-tolerance policy toward child sexual abuse material (CSAM): such material is removed, preserved as evidence where required, and reported to the appropriate authorities and organisations, including Indian law-enforcement and the National Center for Missing & Exploited Children (NCMEC), and the accounts involved are terminated;
• Attempt to probe, disrupt, or gain unauthorised access to the Services, other users' accounts, or our infrastructure; introduce malware; or scrape, harvest, or bulk-collect data from the Services without authorisation;
• Impersonate any person or misrepresent your affiliation;
• Use the Services to send spam or unsolicited commercial communications.

5. User Content

Where a Service enables you to upload, post, or share content ("User Content"), you retain your rights in that content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for technical purposes such as encoding and display), and transmit your User Content solely as needed to operate, provide, and improve the Service. You are responsible for your User Content and represent that you have all rights necessary to share it.

We may review User Content with automated systems (including industry-standard hash-matching technologies used to detect known illegal imagery) and human moderation, and may remove or restrict content, or suspend accounts, that we reasonably believe violate these Terms or the law, as further described in our Privacy Policy. Users can report objectionable content through the reporting mechanisms provided within a Service or by writing to info@gametarian.com.

6. Intellectual property

The Services — including their design, text, graphics, code, and marks — are owned by or licensed to Gametarian and protected by intellectual-property laws. Except as these Terms or a written agreement expressly permit, you may not copy, modify, distribute, or create derivative works from the Services. Client ownership of engagement deliverables is governed by the applicable written agreement.

7. Third-party services

The Services may link to or interoperate with third-party services we do not control. We are not responsible for third-party content, terms, or privacy practices.

8. Disclaimers

The website and any Service offered free of charge are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by applicable law, Gametarian shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Our aggregate liability arising out of or relating to the Services shall not exceed the amounts paid by you to us for the Service giving rise to the claim in the twelve months preceding the event, or ₹10,000 where no amounts were paid. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify and hold Gametarian harmless from claims, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services in violation of these Terms, or your violation of law or third-party rights.

11. Suspension and termination

We may suspend or terminate access to a Service (or any account) for breach of these Terms, for legal or safety reasons, or upon discontinuation of a Service. Sections that by their nature should survive termination (including 5, 6, 9, 10, and 12) survive.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory law to the contrary, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

13. Changes and contact
