How we collect, use, protect, and share personal data — across this website and the services, applications, and platforms we operate.
1. Who we are
Gametarian Interactive Studios Private Limited ("Gametarian", "we", "us") is a company incorporated in India (CIN: U74900WB2015PTC206600) with its registered office in Kolkata, West Bengal, India. We provide software engineering, applied-AI, and related technology services, and we design, build, and operate digital services, applications, and platforms (together, the "Services").
This policy is published in accordance with applicable Indian law, including the Information Technology Act, 2000 and rules made under it, and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). For the purposes of the DPDP Act, Gametarian is the data fiduciary for personal data processed under this policy.
2. Scope
This policy applies to gametarian.com and to any Service we operate that links to or incorporates it. Where a specific Service has additional or supplementary privacy terms, those terms apply together with this policy for that Service.
3. Information we collect
- Information you provide. Contact details and correspondence you submit to us (such as your name, email address, organisation, and the contents of an inquiry); and, where a Service supports accounts, registration details such as your name, contact information, date of birth or age confirmation, and profile information.
- Content you submit.Where a Service enables you to upload, post, share, or transmit content ("User Content"), we process that content in order to provide the Service, and as described in Section 7 (Safety).
- Technical information. Standard technical data such as IP address, device and browser type, and request logs, collected for security, abuse prevention, and service operation. Our website analytics are self-hosted, aggregate, and do not use advertising trackers.
4. How we use information
- To provide, operate, maintain, and improve the Services;
- To respond to inquiries and manage client engagements;
- To secure the Services — including abuse prevention, spam filtering, rate limiting, and fraud detection;
- To keep the Services safe and lawful, as described in Section 7;
- To comply with legal obligations and enforceable requests from public authorities;
- With your consent, for any purpose described at the time consent is sought.
We process personal data on the basis of your consent and for legitimate uses recognised under the DPDP Act. We do not sell personal data, and we do not use it for third-party advertising.
5. Cookies and similar technologies
We keep this minimal. The website sets no advertising or cross-site tracking cookies. Limited technical cookies or local identifiers may be used by our security provider (Cloudflare Turnstile) to distinguish human visitors from automated abuse, and by Services that require sign-in to maintain your session.
6. Service providers and data transfers
We use a small number of infrastructure providers to operate the Services — including hosting (DigitalOcean, with servers located in Singapore), email delivery (Resend), and security verification (Cloudflare). These providers process data on our instructions and under their own security commitments. Because our infrastructure is hosted outside India, your personal data may be transferred to and stored in jurisdictions other than your own; we take reasonable steps to ensure it remains protected as described in this policy, consistent with applicable Indian law on cross-border transfer.
7. User Content and safety
Where a Service permits User Content, we are committed to keeping that Service safe and lawful. You should be aware that:
- User Content may be reviewed by automated systems and, where warranted, by trained personnel, to detect content that violates our terms or the law;
- These automated systems include industry-standard hash-matching and content-matching technologies (such as Microsoft PhotoDNA and similar tools) used to detect known child sexual abuse material (CSAM) and other illegal imagery;
- We maintain a zero-tolerance policy toward CSAM and child exploitation. Where such material is detected, we will remove it, preserve necessary evidence, terminate the accounts involved, and report to the appropriate authorities and organisations — including the National Center for Missing & Exploited Children (NCMEC) and Indian law-enforcement authorities — as required or permitted by law, including the Information Technology Act, 2000 and the Protection of Children from Sexual Offences Act, 2012;
- We may also act on reports from users and third parties, and we provide reporting mechanisms within Services that host User Content.
Data processed for these safety purposes is used only for detection, review, reporting, and legal compliance, and is retained only as long as necessary for those purposes.
8. Data retention
We retain personal data only as long as needed for the purposes described above, to comply with legal obligations, or to establish or defend legal claims — after which it is deleted or anonymised. Inquiry correspondence is retained for the duration of our business relationship and a reasonable period after.
9. Security
We apply reasonable security practices appropriate to the data we hold, including encryption in transit, hardened and access-controlled infrastructure, the principle of least privilege, and continuous integrity monitoring of our production systems. No system is perfectly secure; we encourage you to report suspected vulnerabilities to info@gametarian.com.
10. Your rights
Subject to applicable law, you may:
- Request access to, correction of, or erasure of your personal data;
- Withdraw consent previously given (this does not affect processing already carried out);
- Nominate another individual to exercise your rights in the event of death or incapacity;
- Raise a grievance regarding our handling of your personal data.
To exercise any of these rights, contact us as set out in Section 12. If you are not satisfied with our response, you may complain to the Data Protection Board of India.
11. Children
Our website and consulting services are directed at businesses and are not intended for children. Where a consumer Service we operate is made available to users under 18, we obtain verifiable parental consent where required by the DPDP Act, do not undertake tracking or targeted advertising directed at children, and apply the safety measures described in Section 7.
